Privacy, Data Protection and Complaints

I am committed to protecting and respecting the privacy of anyone’s data I handle and will only use your data in a manner that is appropriate for the reason it has been collected. I do not use automated processing or profiling as I alone am responsible for maintaining client confidentiality.

CONTACT DETAILS

I will collect details about you and your ex partner regarding names, dates of birth, addresses and other contact details when you arrange an appointment for a Mediation Information and Assessment Meeting (MIAM).

During a mediation, other personal and financial information will be requested and held by Md8 solely for the purpose of progressing your circumstances in mediation.  Your details will never be passed on to a third party.

I need to collect this information to conduct and record my services properly under the rules that apply to family mediation or the codes of conduct which govern mediators. It is processed to record my discussions with you, to write up summaries of meetings with you, or a parenting plan, and to prepare what is called a Memorandum of Understanding and an Open Statement of Financial Information which can form the basis for a separation agreement or a consent order to be made by the Family Court.

If I have obtained your specific consent to use information in certain ways you have the right to withdraw this consent at any time, without that affecting the lawfulness of processing based on the consent before its withdrawal. (However, the withdrawal of your consent will not override any exceptions to maintaining confidentiality if safeguarding concerns are raised).

My MIAM and mediation files will be archived after the case is closed. Records are normally retained for six years.

COMPLAINTS

 You are entitled to complain if you are unhappy with the service provided.  Please contact Md8 in the first instance to establish if the matter can be rectified to your satisfaction.  If the complaint is not resolved, you can complain to The Family Mediation Council which can investigate any potential breaches to the Family Mediation Council’s Codes of Practice and Professional Standards.  You can obtain a copy of Md8’s Complaint Procedure on request or look on the website.
